by the respective dates on which these two officers arrived
in Hong Kong, namely 24th November, 1938, in the case of Mr.
Fay, and 16th January, 1940, in the case of Mr. Wright-Nooth.
The question now arises as to their seniority in relation
to the war group of officers appointed since the reoccupation.
Normally the seniority of an Assistant Superintendent of Police
is determined by the date of his appointment to that rank, e.g.,
a Chief Inspector who is promoted to Assistant Superintendent
of Police is senior to a Police Cadet, the date of whose
confirmation as an Assistant Superintendent of Police is sub-
sequent to that of the Chief Inspector's promotion, in spite
of the fact that the Police Cadet has been appointed as such
prior to the Chief Inspector's promotion. Mr. Fay was permitted
to proceed to the rank of and received the salary of Assistant
Superintendent of Police with effect from 24th November, 1940,
but he was not permitted to be confirmed in his appointment in
the Colonial Police Service nor to receive increments until
4th December, 1941, when he passed his final Cantonese language
examination. Mr. Wright-Nooth was selected on the 20th August,
1938, and took the course at the Metropolitan Police College
ending in July, 1939, when he should have proceeded to Hong Kong.
He was called up for the Army in September, 1939, but was released
about six weeks later, arriving eventually in Hong Kong on 16th
January, 1940. He is regarded as confirmed to the permanent
establishment with effect from 16th January, 1942, in accordance
with your Staff Savingram No. 85 of 19th August, 1946.

It might be agreed that both these officers should
be included in the "war group" for purposes of seniority by age
under Colonial Office pamphlet R.D.W.6. I consider, however,
that this would be unfair to them. In the case of Mr. Fay I
prefer to regard him for purposes of seniority as appointed
before the war, taking the date of his appointment as a Police
Cadet, i... 24th November, 1938. Mr. Wright-Nooth's date of
appointment as a Police Cadet is 16th January, 1940. As he
